Geraldine L. Erlank & Associates, Inc. (GLE) focuses on the registration of patents, designs, and trademarks in South Africa. The raison d’etre for GLE, is to facilitate the acquisition of such rights in this country. The focus is to obtain South African patent, design and trademark protection, and the firm therefore offers customised services required to obtain valid patents, industrial designs, and trademark registrations under South Africa’s system which, in respect of patent and designs, does not include substantive examination. A client takes advantage of as few or as many of the offered services as the application may require. For example, GLE can:
- Advise as to whether an invention or design is patentable or registerable in South Africa
- Conduct a search at the South African Patent Office, Designs Office, Trademark Office and/or Companies Office
- Draft the patent specification or prepare the design drawings
- Prepare the patent, design, or trademark application, and lodge it with the South African Registrar
- Attend to all formal matters required to complete the filing of the application
- Attend to voluntary amendments while the application is pending
- Record changes and assignments in the official register
- Act as the intermediary between the applicant and the Patent, Designs or Trademarks Office during pendency to handle any issues that may arise
- Receive and check the Letters Patent documents, or the Design or Trademark Registration Certificates and forward them to the client
- Enter voluntary post-grant amendments to conform the ZA patent claims to the examined, granted claims obtained in countries conducting full examination.
- Maintain the patent, design, or trademark registration.
